Terms and Conditions (T&C) for Trade Single Window
"Trade Single Window" User Terms of Use
(Last Revision Date: 1 May 2026)
The following are the terms and conditions for the use of "Trade Single Window". The Government of the Hong Kong Special Administrative Region ("the Government") agrees to provide services of the "Trade Single Window", and the Registered User of "Trade Single Window" agrees to use the services in accordance with the terms and conditions set out herein.
Definition of the "Trade Single Window"
- "Trade Single Window" (TSW) is a one-stop electronic platform for registered users to submit import and export trade documents/cargo information to the Government online for trade declaration and cargo clearance.
- In these terms and conditions –
- "C&ED" means the Customs and Excise Department.
- "Digital Certificate" is a form of electronic record that serves as an identification of the user in conducting online transactions under the Electronic Transactions Ordinance (Cap. 553).
- "Government" means the Government of the Hong Kong Special Administrative Region.
- "iAM Smart" refers to the one-stop personalised digital services platform launched by the Government. The iAM Smart account provides authentication, the "e-ME" auto form filling and personalised notifications functions. - "iAM Smart+" is another version of the iAM Smart account which provides the additional digital signing function. For more information, please refer to iAM Smart website, https://www.iamsmart.gov.hk/en/.
- "Intellectual Property Rights" means patents, trade marks, service marks, trade names, design rights, copyright, domain names, database rights, rights in know-how, new inventions, designs, processes, and other intellectual property rights whether now known or created in future (of whatever nature and wherever arising) and in each case whether registered or unregistered and including applications for the grant of any such rights.
- "Linked" means a status when a link has been established between a participating government agency's (PGA) System user account and a Registered Account of TSW System to allow the TSW account holder to log in to the PGA's System via the TSW System. For PGA's System which does not have its own service/system-specific user account, "Linked" means a status when access to the PGA's System via the TSW System has been granted.
- "Link Up" means a process/step to establish a link between a user account of PGA's System and a Registered Account of the TSW System which allows the Registered Account holder to access the PGA's System via the TSW System. For PGA's System which does not have its own service/system-specific user account, "Link Up" means a process/step to grant a Registered Account holder of the TSW System the access to a PGA's System.
- "Login via TSW System" means a Registered Account being able to access a Linked PGA System through the TSW System without the need to input the login information of the respective PGA's Systems. For PGA's System that employs a two-factor or multi-factor authentication, it may continue to enforce the second or higher factor of authentication.
- "Online Services" means the services provided on the TSW System.
- "OSWO" means the Office of Trade Single Window Operation of the C&ED which is responsible for the day-to-day operation of the TSW System.
- "PGA" means participating government agency, i.e. a Government department whose trade document(s)/cargo information is handled via the TSW System.
- "PGA's System" means the information technology systems of the PGAs with an interface with the TSW System for the TSW Services. Currently, there are thirteen PGA's Systems, namely:
- "EIES" means the Enhanced Import and Export System;
- "ESLES" means the Endangered Species Licensing and Enforcement System;
- "PPLS" means the Plant and Pesticides Licensing System;
- "CDS" means the Currency and Bearer Negotiable Instruments Declaration System;
- "DCS" means the Dutiable Commodities System;
- "FTP" means the Food Trader Portal;
- "ERLS" means the Electronic Radiation Licensing and Services System;
- "ESPIBM" means the Electronic System for Permit to Import/Transhipment of Biological Materials;
- "IEMS" means the Import/Export Management System (Chinese Medicines);
- "PLAMMS" means the Pharmaceuticals License Application and Movement Monitoring System;
- "RDCS" means the Rough Diamond Control System;
- "RICE" means the Rice Control System;
- "SCCLS" means the Strategic Commodities Classification and Licensing System.
- "Registered Account" means a user account registered and created in the TSW System as specified by the OSWO. There are three types of Registered Account available for individual and business entity/organisation users:
- To be registered by individual users
- (i) Individual Account;
- To be registered by business entity/organisation users
- (ii) Company/Organisation (Administrator) Account; and
- (iii) Company/Organisation (User) Account
- "Registered Business Entity/Organisation" means, the business entity/organisation with registered user(s) in the TSW System. Business entity/organisation with the same Hong Kong Business Registration Number/organisation number and name would be considered as the same business entity/organisation.
- "Registered User" means an individual or business entity/organisation whose name is registered for at least one Registered Account in the TSW System.
- "TSW System" means the information system specified in Schedule 4 of the Import and Export Ordinance (Cap. 60) that provides the TSW Services.
- "TSW Services" means the services for Registered Users to submit import and export trade document(s)/cargo information to the Government for trade declaration and cargo clearance through the TSW System.
Under the Agriculture, Fisheries and Conservation Department (AFCD)
Application
- The Registered User requests the OSWO to provide electronic services and the OSWO, upon receiving the Registered User's acceptance of the terms and conditions hereinafter set out, agrees to provide electronic services as described below through the TSW System, and the use of services in the TSW System shall at all times be governed by these terms and conditions.
Purpose of Collection and Handling of Personal Data
- Regarding the use of personal data provided to the TSW System, please refer to the "Personal Information Collection Statement" as shown in the following paragraphs and the "Privacy Policy Statement" for details.
- The Government of the Hong Kong Special Administrative Region ("the Government") is concerned to ensure that all personal data submitted through and stored in the Trade Single Window System ("TSW System") is handled in accordance with the relevant provisions of the Personal Data (Privacy) Ordinance (PD(P)O).
- The personal data provided by any user during the registration process (as well as subsequent updates) and the personal data, if any, to be submitted by the user during the subscription/application/submission of the trade document(s)/cargo information through the TSW System will be used by the Office of Single Window Operation (OSWO) and participating government agencies (PGAs) of the Government for the following purposes:
- (a) processing / recording of user registration;
- (b) performing account link up and single sign-on functions with relevant PGAs' systems;
- (c) processing subscription/applications/submissions in relation to the trade document(s) and cargo information supported by the TSW System;
- (d) facilitating import and export cargo clearance;
- (e) exercising import and export controls over the cargo;
- (f) detection and prevention of crime;
- (g) discharging various duties and functions of PGAs; and/or
- (h) facilitating communications between the Registered User and any representative of the relevant departments of the Government.
- The provision of personal data is voluntary. However, if the user does not provide sufficient information, he/she may not be able to prove his/her eligibility for registration, and the TSW System may not be able to process his/her application/submission of trade document(s)/cargo information for trade declaration and cargo clearance.
- The personal data provided by a user may be disclosed to PGAs, other Government departments, and enforcement agencies outside Hong Kong, for any of the purposes mentioned in paragraph 2 above; or where such disclosure is authorised, required or permitted by law or court order. Apart from this, the personal data shall only be disclosed to parties which you have given consent to such disclosure or which such disclosure is allowed under the PD(P)O.
- By using the TSW System, any Registered User hereby agrees to give consent to the Government for retention of information (including the Registered User's personal data) contained in the profile of the Registered Account in the TSW System after termination of the account for matters arising out of or in relation to the use of the TSW System and the PGAs' online services.
- Any user has a right of access and correction with respect to personal data as provided for in sections 18 and 22 and Principle 6 of Schedule 1 to the PD(P)O. A fee may be imposed for complying with a data access request.

Registration and Creation of Account

- 5.1 Any individual or business entity/organisation applying for registration shall apply through the TSW System for a Registered Account for accessing and using services of the TSW System.
- 5.2 The Registered User undertakes to provide true and accurate information, including the supporting documents as required, in both the registration and other application/submission processes. The Registered User is liable for all direct and indirect legal consequences, losses and damages arising out of or resulting from his/her failure to do so.
- 5.3 In using iAM Smart/iAM Smart+ account or Digital Certificate for registration in the TSW System, the user shall ensure that the information provided in the TSW System align with that in the iAM Smart or Digital Certificate profile. The OSWO reserves the right to reject the application with inconsistent information.
- 5.4 The OSWO reserves the right not to accept any registration with an inappropriate account name which is considered likely to be offensive to a reasonable person, or has a connotation offensive to good taste or decency.
- 5.5 All registrations as Registered User are subject to the OSWO's approval. There are three types of Registered Account available and their respective registration requirements are as follows -
- Individual Account
- A Hong Kong resident (holding a Hong Kong Identity Card) or non-Hong Kong resident (holding a valid travel document but not a Hong Kong Identity Card) can register to create a Registered Account and be a Registered User in the TSW System.
- Company/Organisation (Administrator) Account
- A local business entity (i.e. a sole proprietorship, partnership or a limited company) holding a valid business registration certificate issued under section 6 of the Business Registration Ordinance (Cap. 310); or a non-local business entity (i.e. a sole proprietorship, partnership or a limited company) holding a valid business registration document issued by a competent authority; or an organisation (e.g. universities, organisations registered under the Societies Ordinance (Cap. 151), etc.); or a charitable institution or trust of a public character under section 88 of the Inland Revenue Ordinance (Cap. 112) can register to create a Company/Organisation (Administrator) Account in the TSW System.
- Business entities/Organisations with the same Hong Kong Business Registration Number/Organisation number and name are considered the same Business entity/Organisation.
- The Registered User has to appoint in writing an authorised person ("Authorised Administrator") for the operation of the Company/Organisation (Administrator) Account. The Registered User may authorise the creation and cancellation of Company/Organisation (User) Account(s) through a Company/Organisation (Administrator) Account. The Registered User can also set up user pool(s), if applicable, in a Registered Business entity/Organisation to view and manage the pool members' applications and assign delegation for certain types of trade documents.
- Company/Organisation (User) Account
- The Registered User holding a valid Company/Organisation (Administrator) Account can create one or more Company/Organisation (User) Account(s) in the TSW System subject to his/her business needs. Same as the authorisation process described in Company/Organisation (Administrator) Account above, any person appointed as the user ("Authorised User") of the Company/Organisation (User) Account(s) must be supported in writing by an authorisation letter.
User Pool (for Company/Organisation Account only)
- For Registered Business entity/Organisation users, if applicable, Company/Organisation (Administrator) can create user pool in the same Registered Business entity/Organisation to view and manage pool members' applications and assign delegation for certain types of trade document.
The use of iAM Smart/iAM Smart+ in the TSW System

- 7.1 In using the iAM Smart or iAM Smart+ account to create a Registered Account and log in to the TSW System, the user gives permission for the TSW System to access, collect and use his/her personal data in the iAM Smart system in accordance with the Privacy Policy of the TSW System, including but not limited to –
- For form filling function activated in iAM Smart or iAM Smart+ account:
- English Name;
- Chinese Name;
- Hong Kong Identity Card Number;
- Email address; and
- Phone number (mobile/office/home).
- For form filling function not activated in iAM Smart or iAM Smart+ account:
- English Name;
- Chinese Name; and
- Hong Kong Identity Card Number.
- For form filling function activated in iAM Smart or iAM Smart+ account:
- 7.2 Apart from using iAM Smart and iAM Smart+ account to log in to the TSW System, Registered Users can also use the Registered Account name and password to log in to the TSW System.
- 7.1 In using the iAM Smart or iAM Smart+ account to create a Registered Account and log in to the TSW System, the user gives permission for the TSW System to access, collect and use his/her personal data in the iAM Smart system in accordance with the Privacy Policy of the TSW System, including but not limited to –
Subscription to Online Services

- 8.1 Subscription to the Online Services of trade document(s)/cargo information is required before using the services in the TSW System. For detailed requirements on subscription, please refer to the subscription terms and conditions of each type of trade document/cargo information.
- 8.2 For trade document(s)/cargo information with no pre-requisite for subscription, the subscription shall take immediate effect and online submission could be made immediately after subscription.
- 8.3 For those trade document(s)/cargo information with pre-requisite for subscription, subject to the requirement of specific type of trade document/cargo information, the time required for approval of subscription varies. The subscription shall take effect after the respective PGAs have verified and/or approved the required information and/or supporting documents. The verification process varies depending on the performance pledge of different PGAs.
Log in to PGA's Systems via TSW System

- 9.1 A Registered User may log in to a PGA's System via the TSW System after a Link Up is established, provided that the PGA's System supports "Login via TSW System" and the Registered User has subscribed to the online services of the related trade document(s). By establishing a Link Up and for any subsequent use of a Linked PGA's System online service, the Registered User agrees that information/data and the supporting documents kept in the personal profile of his/her Registered Account may be transferred to and/or used by the Government (including the PGA's System concerned and the TSW System) upon their request in accordance with the terms and conditions set out herein. The TSW System would notify the PGA's System of any updated data in the personal profile of the Linked account. Whether the user account profile of the PGA's System would be updated subsequently is subject to PGA's System's arrangement.
- 9.2 Some PGAs may require the Registered User to create a user account at the PGA's System before establishing a Link Up between the TSW Registered Account and the user account in the PGA's System.
- 9.3 If any of the profile data of a Registered User, required for the purpose of a Link Up with a PGA's System, has been revised, the Link Up established for such online service may be delinked by the PGA's System subject to the relevant PGA's decision. If the Link Up is delinked, the Registered User will not be able to access the Linked PGA's System by using Login via TSW System until the Link Up is re-established.
- 9.4 Depending on the requirements of a PGA, the data required for a Link Up with any of its online service may change from time to time. If there is any new requirement, the Registered User shall revise or provide any required information in the profile of his/her Registered Account in order to maintain the Link Up.
- 9.5 A Linked account may be delinked either by the TSW System or the PGA's System for reasons including but not limited to those listed below:
- the TSW Registered Account is de-registered or disabled;
- the digital certificate of the Linked account user is expired;
- a Linked account user is declined from accessing the PGA's System by the concerned PGA for reasons including but not limited to licence suspension, expiry of digital certificate, invalid information or document provided for the Link Up, or suspended/terminated user accounts at the relevant PGA's System;
- it is considered unsafe to allow a Linked account to access the PGA's System via the TSW System concerned; or
- a Registered User unsubscribes the Linked services in the TSW System.
- 9.6 After termination of the established Link Up made in respect of the TSW Registered Account and the PGA's System concerned, the relevant subscribed service of the Registered User may be automatically unsubscribed by the TSW System and the Registered User may not be able to access the online service of the relevant PGA's System by using the Login via TSW System function in the TSW System. A fresh subscription and subsequent Link Up with the PGA's System has to be re-submitted if the user wishes to use the Login via TSW System function of the TSW System to access the PGA's System again. For application submitted successfully before "termination of an established Link Up", the submitted application would still be handled by the Government. Please contact the TSW System helpdesk or respective PGAs for subsequent action.
- 9.7 After the Linked service was delinked, subject to PGA's decision, user may no longer be able to gain access to the information related to that service in the TSW System.
- 9.8 While the user may access the PGA's System by using Login via TSW System of the TSW System, there may be circumstances where access to the PGA's System through the TSW System would not be available, for reasons such as interruption of the TSW System or PGA's System.
Services and functions provided in the TSW System

- 10.1 The TSW Services are subject to the dependent (if any) PGA's System and provided on an "AS IS" basis.
- 10.2 The Government reserves the right to make or change procedures for the use of any of the TSW Services and add, modify, suspend or terminate any services and functions (including but not limited to Login via the TSW System, "User Pool features" and "Notifications") as necessary without recourse to seeking the prior agreement or giving prior notice to any user.
- 10.3 The TSW System will, subject to the governance of these terms and conditions and the laws of the Hong Kong Special Administrative Region, enable the Registered User to perform the following functions: -
- Submission of application/trade document(s)/cargo information: a Registered User can submit trade document(s)/cargo information or applications for licence/permit, related to import, export, transhipment or transit of an article, in the TSW System in electronic form of the following trade documents:
Agriculture, Fisheries and Conservation Department (AFCD)- Import/Export Licence for Pesticides
- Toothfish Import/Export/Re-export Licence
- Plant Import Licence
- Licence to Export/Re-export for Endangered Species
- Licence to Import for Endangered Species
- Permit for Import of Mammals from the Mainland and Animal Products
- Re-export Certificate for Species of non-Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or not yet Controlled under the Protection of Endangered Species of Animals and Plants Ordinance (Cap. 586)
- Special Permit for Import of Dogs and Cats from Overseas
- Special Permit for Import of Animals and Birds from Overseas

- Login via the TSW System: a Registered User can use online functions at the TSW System to Link Up and Login via the TSW System to PGA's System for trade document application and viewing, etc. PGA's Systems and relevant trade documents are listed below:

- Verification of the validity of an electronic licence/permit: A Registered User can use online functions at the TSW System to verify the validity of the trade documents issued via the TSW2.
- User Pool features: Registered Business Entity/Organisation users may use online functions at the TSW System to create user pools in the same Registered Business Entity/Organisation to view and manage the pool members' applications and assign delegation for certain types of trade documents.
- Notifications: A Registered User may access his/her TSW notification box after having logged in to his/her Registered Account and view the messages sent by the Government. Some messages may require the Registered User's action or attention, such as registration information update, licence/permit approval or user pool update, government query, etc., and a notification will also be sent to the Registered User's email address, if applicable. For individual truck driver registered in TSW, Short Message Service (SMS) notifications on software token activation, login information of the Interactive Voice Response System (IVRS), etc., will be sent to his/her mobile phone number. The Registered User shall keep the email address/mobile phone number in the personal profile of his/her TSW Registered Account up-to-date.
- Submission of application/trade document(s)/cargo information: a Registered User can submit trade document(s)/cargo information or applications for licence/permit, related to import, export, transhipment or transit of an article, in the TSW System in electronic form of the following trade documents:
- 10.4 For trade documents to be issued in electronic form, upon the approval of the application, the PGA concerned will issue the approved trade document via the TSW System and/or the relevant PGA's System. For the trade document issued via the TSW System, unless the contrary is proven, it is deemed to be issued to and subsequently received by the Registered User at the time when the approved trade document is sent to the Registered Account through the TSW System.
- 10.5 For trade documents to be issued in paper form, upon the approval of the application, the PGA concerned may issue an email, a message to the notification box of the Registered User or an on-screen message informing the Registered User on the arrangement for collecting the trade document.
- 10.6 The OSWO reserves the right to change the scope of services and coverage of trade documents at any time as necessary, and suspend or discontinue the services of the TSW System (or any part thereof) with or without prior notice.
Payment
- The Registered User shall settle the fees required for the application for a trade document as specified in the TSW System, if applicable. For payment requirement in PGA's System, please follow the procedure in PGA's System.
Disabling of a Registered Account
- The OSWO reserves the right to disable the Registered Account without prior notice if -
- any information or document provided for creating the Registered Account is no longer valid;
- there is any breach by the Registered User of the terms and conditions herein;
- the operation of the Registered Account is suspected of prejudicing the operation of the TSW System;
- the Registered Account has not been used or logged in for a continuous period of three years; or
- the Registered User as a business entity/organisation ceases to operate.
Restriction of usage of a Registered Account
- The OSWO reserves the right to restrict the services or functions available for use by a Registered Account if the Registered User updates any information or document in the user profile until the update was verified by the OSWO.
De-registration of Registered Account

- 14.1 The Registered User may de-register his/her Registered Account. De-registration will inactivate the Registered Account permanently. The Registered User –
- can no longer use it to log in to the TSW System to gain access to any of the trade document(s)/cargo information processed by the account; and
- shall remain bound by these terms and conditions on matters/issues arising from the activities performed in the TSW System before the de-registration process is completed.
- 14.2 The OSWO reserves the right to invalidate a Registered Account without prior notice.
- 14.1 The Registered User may de-register his/her Registered Account. De-registration will inactivate the Registered Account permanently. The Registered User –
Consent to access and use of data in the PGA's System

- 15.1 By using the TSW System, a Registered User consents to transfer respective trade documents' application data and licence/permit issuance data (in regard to applications submitted by the Registered User in the TSW System) under his/her Registered Account to ERLS, ESLES, EIES, IEMS, PPLS, RICE and DCS.
- 15.2 By using the TSW System, a Registered User and the respective Registered Business Entity/Organisation for which the Registered User makes an application consent to the transfer of his/her information on all trade documents (including application status of the trade documents and licence/permit status) in PLAMMS/SCCLS/FTP/CDS, which are applied by and issued to him/her and the respective Registered Business Entity/Organisation, to the TSW System.
Responsibilities
-
- 16.1 The Registered User –
- agrees to use the services and the TSW System only for purposes that are permitted by these terms and conditions and the laws of the Hong Kong Special Administrative Region;
- represents, warrants and undertakes that any information, communication or material submitted to the Government through the TSW System is true and accurate and not misleading, incomplete or false in any material respect;
- acknowledges that the password for access to the TSW System is confidential and shall not be disclosed to any other person(s) under any circumstances. The Registered User shall act in good faith, exercise reasonable care and diligence in maintaining the confidentiality of his/her password. At no time and under no circumstances shall the Registered User allow any other person to use his/her password to gain access to the TSW System on the Registered User's behalf. Any access to the electronic services with the username and password, including the use of iAM Smart and iAM Smart+, shall be deemed the use of the electronic services of the TSW System by the Registered User concerned;
- shall notify the OSWO immediately via their 24-hour hotline (2117 3348) if the Registered User becomes aware of, or suspect any compromise or unauthorised use of his/her TSW account;
- shall be liable for all transactions performed under his/her Registered Account and all civil and criminal liabilities arising thereof. The OSWO and the Government shall be under no obligation whatsoever to investigate or verify the authority of persons using his/her Registered Account. The Registered User agrees to indemnify the OSWO and the Government against any loss, damage or liability that may be suffered by the OSWO and the Government as a result of or in connection with the use of electronic services of the TSW System by the Registered User; and
- shall notify the OSWO immediately using the TSW System or in writing upon any change of the address, contact person, contact telephone number, email address, fax number or any other information in the account profile of the Registered User provided to the OSWO for the purposes of obtaining the electronic services of the TSW System.
- 16.2 For a Registered User holding a Company/Organisation (Administrator) Account(s) and/or Company/Organisation (User) Account(s), the Registered User –
- shall ensure that the Authorised Administrators and Authorised Users in his/her business entity/organisation shall comply with the requirement as set out in these terms and conditions when using the Registered Accounts;
- shall ensure that update is made to the status of the Registered Account(s) through the Company/Organisation (Administrator) Account in the TSW System in case any Authorised Administrator or Authorised User ceases to act on behalf of the Registered User. The Registered User shall still be liable for all the transactions made through these Registered Account(s) before the updates are received by the TSW System;
- shall ensure that the Authorised Administrator(s) will notify the OSWO in writing immediately when the Registered Business Entity/Organisation ceases to operate. The OSWO may in turn disable all or some of the Registered Account(s) in question without prior notice; and
- shall ensure that there is at least one valid Company/Organisation (Administrator) Account at all times to serve as a contact point with the Government.
- 16.3 System Logging of User Activities
- The Registered User activities under the TSW System are subject to logging and review by the Government for the following purposes:
- System diagnosis and trouble-shooting;
- Capacity planning and service improvement;
- Identification of any abuse of Service;
- Provision of information upon the Government's request; and
- Provision of information upon request of court or as required by law.
- The log retention period is up to 7 years.
- The Registered User activities under the TSW System are subject to logging and review by the Government for the following purposes:
- 16.4 The Registered User agrees not to use the services and the TSW System:
- in any way that is illegal;
- to upload, post, email, transmit or post links to any contents which are defamatory, offensive, unlawful, obscene, abusive, harmful, pornographic, threatening, tortious, or otherwise objectionable;
- to upload, post, email, transmit or post links to any information or software which contains any computer viruses, worms, Trojan horses or any other harmful computer codes, programs or files;
- to access, use, break into, attempt to access, use or break into any other parts of the TSW System and/or data areas which the Registered User has not been authorised to use;
- to access, collect or store personal data about other users without authorisation; to upload, post, email, transmit or post links to any promotional material, unauthorised advertising, chain letters, pyramid schemes or any unsolicited commercial communication; and
- in any way that contravenes the provisions of these terms and conditions or infringes upon the Government's rights or the rights of any person (including Intellectual Property Rights or any other rights).
- 16.5 The Registered User shall not do or attempt to:
- decompile, reverse-engineer, convert, adapt, alter, modify, enhance, add to, delete or in any way tamper with the services, the TSW System or any contents in them; and/or
- do anything to exploit, interfere or disrupt the services, the TSW System or the servers and networks through which they are provided.
- 16.6 If a Registered User breaches his/her obligations under these terms and conditions, his/her TSW account may be invalidated and further legal actions may be taken.
- 16.1 The Registered User –
Limitation of Liability
- The OSWO shall not be liable to the Registered User or any third party for any variation, suspension or discontinuance of the TSW System. Neither the OSWO, the PGAs, the Government, nor their officers or employees shall be responsible for any delays and failure in transmission, receipt or execution of information, messages or instructions due to a breakdown or failure of communication facilities or to any other cause whatsoever and they shall not be liable for any losses, fees, costs, expenses, damages and liabilities suffered or incurred as a result thereof.
Indemnity
- The Registered User shall indemnify and keep indemnified the Government against all claims, actions, proceedings, arbitrations, liabilities, indebtedness, demands, charges, damages, costs, losses or expenses arising out of or in relation to the use or attempted use of the TSW System and the services to the extent that the same are or have been caused by any negligent or reckless conduct, wilful misconduct, omission, defamation, breach of statutory duty or breach of any of the terms and conditions by him/her. This provision survives suspension or invalidation of his/her TSW account.
Communication
- Any communication, including the issuance of trade documents, sent to the Registered User by means of contact as recorded in the TSW System or the notification box is deemed to have been sent to and subsequently received by the Registered User at the timing of sending, unless the contrary is proved.
Intellectual Property Rights

- 20.1 Unless otherwise indicated, the contents in the TSW System, including but not limited to all text, graphic, images, logos, icons, sound clips, video clips, compilation of data, page layout, underlying code (including object and source codes), software and any other materials, are subject to Intellectual Property Rights owned by the Government.
- 20.2 The Government hereby grants the Registered User a worldwide, non-transferable, non-sublicensable, non-exclusive and revocable licence for using the contents of the TSW System solely for and/or in relation to the functions stipulated in Clause 27 above. Save as aforesaid, prior written consent of the Government is required if the Registered User intends to reproduce, distribute or otherwise use directly or indirectly any contents in the TSW System in any ways or for any other purposes. Such requests for consent shall be addressed to the TSW System helpdesk via email (enquiry@tradesinglewindow.hk). The licence or permission given in this Clause does not extend to any contents on other websites linked to or from the TSW System, or any contents on the TSW System, the Intellectual Property Rights of which belong to a third party.
- 20.3 If the Registered User intends to use any contents of the TSW System of which the Intellectual Property Rights are owned by third parties, the Registered User must separately obtain from such third party Intellectual Property Rights owner authorisation or permission to reproduce or distribute or otherwise use any such contents.
- 20.4 Unless otherwise indicated, the Government retains all rights, titles, beneficial ownership and interests (including Intellectual Property Rights) on all text, graphic, images, logos, icons, sound clips, video clips, compilation of data, page layout, underlying code (including object and source codes), software and any other materials in and of the TSW System. This TSW System shall be and shall remain the Government's exclusive property and shall vest in the Government absolutely.
- 20.5 "Use", for the purposes of Clauses 47-48 of these terms and conditions, includes any acts restricted by copyright (including reproduction) set out in sections 22 to 29 of the Copyright Ordinance (Chapter 528 of the Laws of Hong Kong).
Acceptance of Terms and Conditions

- 21.1 The Government may from time to time vary, modify, delete and/or add any clause in the terms and conditions at its own discretion. The Registered User will be notified of updates or changes. The Registered User shall read the revised terms and conditions before proceeding to use the services. His/her accessing and using of the TSW System is taken as an agreement to be legally bound by the terms and conditions as may be varied, modified and/or supplemented from time to time by the Government without prior notice. The revised terms and conditions will supersede any previous versions of the terms and conditions accepted. The terms and conditions herein are published in both Chinese and English. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
- 21.2 The OSWO reserves the absolute right to interpret these terms and conditions and the OSWO's interpretation shall be final in the event of dispute arising thereof.
Contingency
- If the electronic services of the TSW System are not available, the OSWO will, as soon as practicable, publish a notification on the website of the TSW System. The Registered Users shall follow the contingency arrangement as required by the respective PGAs to follow up the applications processed by the TSW System.
Linked Information and other Third-Party Websites
- The TSW System may provide or assist in providing links to third-party websites through any parts of the web interface solely for convenience to users of the TSW System. Provision of, or assistance in providing, any links to third-party websites on the TSW System does not give rise to any statements, representations or warranties, express or implied, that the Government agrees with, approves, recommends or endorses the contents of any such third-party websites. The provision of any links to third-party websites shall not constitute any form of co-operation or affiliation of any such third parties or external websites with the Government. The Government shall not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including but not limited to direct or indirect loss, consequential loss, destruction or damage) howsoever arising from or in respect of the Registered User's use or misuse of or reliance on, or inability to use such links to any third-party website or his/her use or reliance on the contents of any such third-party websites. The Registered User should refer to the terms and conditions of each such third-party website when using such website.
Governing Law
- The terms and conditions herein shall be governed by the laws of the Hong Kong Special Administrative Region.

- I am applying for subscription service with C&ED through Trade Single Window (TSW) website. I declare the particulars provided by me herein are true and correct, and I undertake to notify C&ED through TSW website once there is any change of particulars regarding this subscription.

Personal Information Collection Statement
Purpose of Collection
- The personal data you provided in this subscription (as well as subsequent updates) and the personal data, if any, to be submitted by you through the TSW website as a subscribed user will be used by C&ED for one or more of the following purposes:
- processing / recording of registration or subscription application;
- exercising import and export control of cargo;
- detection and prevention of crime;
- discharging various duties and functions of C&ED; and / or
- facilitating communications between you and any representative of C&ED.
- If you do not provide sufficient information for subscription, you will not be able to submit cargo information through the TSW website.
- Video cameras are installed to record activities at the Customs Clearance Points. Video recording of you at the Customs Clearance Points may be used by C&ED for one or more of the purposes mentioned in paragraph 1 above.
- The personal data you provided in this subscription (as well as subsequent updates) and the personal data, if any, to be submitted by you through TSW website as a subscribed user and the video recording of you at the Customs Clearance Points may be disclosed to other Government departments / bureaux and overseas enforcement agencies for any of the purposes mentioned in paragraph 1 above; or where such disclosure is authorised or required by law.
- In case your vehicle carries a consignment of cargo across the boundary, the Hong Kong vehicle registration number may be disclosed to the relevant trade user of the cargo consignment as a facilitation measure.
- Under the Personal Data (Privacy) Ordinance, you have a right of access and correction with respect to your personal data you provided in TSW website. Your right of access includes the right to obtain a copy of your personal data you provide. In accordance with the terms of the Ordinance, we have the right to charge a reasonable fee for the processing of any data access request.
